Our client was charged with criminal damage to public property, specifically involving damage to assets belonging to the public transportation system. From the outset, the client demonstrated genuine remorse and took proactive steps to remedy the harm, including engaging with relevant authorities to make amends.
Recognising these mitigating factors, we successfully persuaded the prosecution to consent to a diversion program—a significant achievement given the nature of the charge. However, despite prosecutorial consent, the court ultimately declined to grant the diversion.
Faced with this unexpected outcome, we immediately pivoted our strategy. After a thorough reassessment, we advised the client to enter a guilty plea, taking into account:
The strength of the prosecution’s case and evidentiary position.
The client’s soon-to-expire visa, which added urgency to resolving the matter.
The ongoing mental and emotional impact of the proceedings on the client.
The client’s clear instructions and priorities.
This case underscores the importance of strategy and client-focused advocacy. By adapting promptly and aligning our approach with both legal realities and the client’s circumstances, we ensured the best possible outcome under challenging conditions.
