Will

遺囑

A Will is a legal document that directs what happens to your assets when you die. It speaks for you when you no longer can.

At its core, your Will performs four essential functions.

遺囑是一份法律文件，用以決定您離世後資產的處理方式。當您無法再表達意願時，遺囑將代表您的意願。

您的遺囑主要具有四項重要功能。

1. Appointment of Executor

   委任遺囑執行人

Your Will appoints an executor.

遺囑會委任一名或多名遺囑執行人。

The executor is the person (or people) you trust to carry out your wishes.

遺囑執行人是您信任、負責執行您遺願的人。

Their responsibilities include:

其職責包括：

• applying for probate if required

  如有需要，申請遺囑認證（Probate）
  

• identifying and collecting your assets

  確認及收集您的資產
  

• paying your debts, taxes, and expenses

  支付您的債務、稅項及支出
  

• distributing your estate in accordance with your Will

  根據遺囑分配遺產
  

An executor is not automatically entitled to payment unless the Will specifically allows it.

除非遺囑另有規定，否則遺囑執行人一般不會因履行職責而自動獲得報酬。

2. Distribution of Your Assets

   資產分配

Your Will determines who receives your estate and in what proportions.

您的遺囑將決定誰可繼承您的遺產，以及各自所佔比例。

Your estate generally includes:

• real property

  房地產
  

• bank accounts

  銀行帳戶
  

• investments

  投資
  

• personal belongings

  個人物品
  

• other assets owned solely by you

  其他由您單獨擁有之資產
  

Certain assets may not form part of your estate, including:

部分資產未必屬於遺產範圍，包括：

• superannuation (unless paid to your estate)

  退休金（除非支付至您的遺產）
  

• jointly owned assets held as joint tenants

  以 Joint Tenants 形式共同持有之資產
  

• assets with nominated beneficiaries

  已指定受益人之資產

3. Substitute Beneficiaries

   替代受益人

Your Will can provide for what happens if a beneficiary does not survive you.

This reduces uncertainty and helps avoid disputes.

遺囑可安排若受益人先於您離世時的處理方式。

此安排可減少不確定性及爭議。

4. Appointment of Guardians

   委任監護人

If you have children under 18, your Will may appoint a guardian.

This is the person you nominate to care for your children if you die before they reach adulthood.

如您有未滿 18 歲子女，遺囑可委任監護人。

即當您於子女成年前離世時，由您指定照顧子女的人。
